CITY COUNCIL MEETING
MINUTES
October 15, 2007

PRESENT:
Present: Mayor Todd Eberle; Council Members Loretta Ertel, Sandra Leonard, Stuart Miles, Alan Simon, Sandra Tucci and Lee Zimmerman; City Attorney Grover Potts; City Administrator Ann Simms; Police Chief Marvin Wilson; Recording Secretary Ann Melton; Court Reporter Bruce Handy.
Mayor Eberle called the meeting to order at 7:30 p.m.
APPROVAL OF MINUTES:
Council Member Simon moved approval of the minutes of the regular City Council Meeting of September 17, 2007; Council Member Ertel seconded: passed unanimously.
MAYOR'S REPORT:
Mayor Eberle introduced Christina Poole with U. S. Congressman Geoff Davis' office and thanked her for her attendance. She reviewed some of the services that Congressman Davis and his staff can provide for residents of Prospect who live in the Oldham County portion of the city.
Mayor Eberle reviewed a schedule of coming events in Prospect. On Saturday, October 20, Prospect Emergency Preparedness Committee will host Prospect Emergency Preparedness Day, from 10:00 a. m. to 2:00 p.m. On October 21, Hunting Hills Condominium will host a block watch party. The City's annual Punkin' Pantin' celebration will be held on October 28, from 2:30 p.m. to 4:30 p.m. The Prospect Reading Center Fall Book Sale will be held on November 8, 9 and 10, with Thursday, November 8 being exclusively for Prospect residents. Mayor's Beautiful Day will be held on November 10th from 9 a.m. until 12:00 noon with free distribution of bulbs for planting. Light up Prospect will be held on November 30, beginning at 6:15 p.m. at the Cowley Open space, proceeding from that location to the various neighborhoods of the City.
Mayor Eberle also reported that the Annual Audit of City Funds should be completed by the November Council meeting, all road paving projects have been completed for the calendar year, and the City of Prospects wall calendar should be mailed to all residents no later than December 1 st .
POLICE REPORT :
Police Chief Marvin Wilson presented the monthly police report. He reminded everyone that the Hunting Hills Condominium Association has established a block watch group. On October 21, from 4:00 to 6:00 p.m. the Police Department will be attending and assisting with their Block Watch Pot Luck Dinner Party. The recently conducted self defense training class was a clear success with approximately 22 people in attendance. He reported that the City had received another grant for in-car computers. This enables our police officers to check vehicle registration, check for outstanding arrest warrants, check on the validity of operator's licenses, and check on required automobile liability insurance directly from police vehicles. Four police cars now have computers and he hopes eventually to equip all seven patrol cars.

UNFINISHED BUSINESS:
Mayor Eberle updated the Council on The Overlook at Harrods Creek Condominiums and the unresolved issues concerning the Binding Elements to the Development Agreement between the City and Premier Land Company. He thanked residents of The Overlook in attendance for their continuing interest in the project and reiterated that the City's goal was to have the development fully completed as soon as possible, in a manner which will protect the owners and the City in the future. He noted further that the problems with the upper slope seem to have been adequately addressed, but the issues regarding possible erosion on the lower slope and creek bank as well as construction of the pathway through the property are yet to be resolved. Peggy Haggerty Duffy, the engineer who is advising the city on the slope failure issues then addressed the Council. She has made follow-up site visits to The Overlook property. Ms. Duffy confirmed that the upper slope remediation had been largely completed and that the process had been conducted as agreed upon. She then restated the two overall issues with the slope: 1) slope stability relative to geography and soil strength, and 2) erosion control concerns with the slope being adjacent to the creek. She told the Council that a comprehensive study of the lower slope would be advisable in that the creek has changed significantly in recent years. Such a study may reveal that the proposed erosion control measures are currently adequate, or reveal that we must do something more aggressive. In the fairly near future we could face a major loss of material into the creek along with possible fines from the Metropolitan Sewer District, the U.S. Corps of Engineers, and the Metro Division of Water. She again emphasized the need for the University of Louisville expert on hydrology and stream bank restorations, Dr. Arthur Parola, to conduct an in-depth study and make any necessary recommendations for possible current or future remedies to protect the slope. Mayor Eberle asked whether, if the lower slope study were to be completed by December 1, 2007, an agreement could be reached on what if anything should be done by February 1, 2008 with any necessary work completed by August 1, 2008. Ms. Duffy indicated that this would be a workable time frame, depending on the date when Dr. Parola's calendar would allow him to commence the study.
Council Member Sandra Tucci moved FIRST READING, for introduction and discussion to ORDINANCE 482, SERIES 2007: AN ORDINANCE AMENDING CHAPTER 38 OF THE CODE OF ORDINANCES OF THE CITY OF PROSPECT RELATING TO THE CITY CODE OF ETHICS.
Council Member Stuart Miles moved FIRST READING, for introduction and discussion to ORDINANCE 483, SERIES 2007: AN ORDINANCE AMENDING CHAPTER 32 OF THE CODE OF ORDINANCES OF THE CITY OF PROSPECT RELATING TO THE TIME OF CITY COUNCIL MEETINGS.
EXECUTIVE SESSION:
No need for an executive session was noted and none was requested.
ADJOURNMENT:
Council Member Simon moved for adjournment; Council Member Leonard seconded; passed unanimously.
Mayor Eberle declared the meeting adjourned at 9:58 p.m.
