CITY OF PROSPECT
CITY COUNCIL MEETING
November 15, 1999
PRESENT:
Mayor Lonnie Falk; Council Members Raymond Burse, Nan Milliman, Harold Smith,
Alan Simon, Lee Zimmerman, Sandra Tucci; City Attorney Grover Potts, City
Administrator Ann Simms; Lt. Larry Johnson; Recording Secretary Phyllis A.
O’Donnell.
Mayor Falk called the meeting to order at 7:30 p.m.
APPROVAL OF MINUTES:
Council Member Burse moved approval of the minutes of the regular City Council
Meeting of October 18, 1999; Council Member Smith seconded; passed unanimously.
SPECIAL ORDER
Mayor Falk requested the City Council Advise and Consent for the appointment
of Grover C. Potts Jr. to be City Attorney Council Member Milliman moved approval;
Council Member Burse seconded; passed unanimously.
Mayor Falk administered the Oath of Office to Grover C. Potts and welcomed him as the new City Attorney.
COMMENTS FROM CITIZENS
David Krost and Mr. and Mrs. John Herzfeld, members of the Library Committee,
were in attendance. Mr. Krost spoke briefly and presented a preliminary report
on the activities of the committee and presented a proposal to the City Council
on moving forward with a community center that will provide an upgrade to
existing areas in City Hall,to include the Police Department, City Council
Meeting Chamber and Mayor and Staff Offices and Facilities; New Services and
Facilities to include a Book Lending Mini-Library, Reading Areas, Community
Meeting Spaces, Children's Area, Computer Facilities, Improved Parking and
Green Spaces. The Committee will be looking at budget and preliminary architectural
plans. Council Member Simon moved that the Library Committee move forward
with their plans; Council Member Milliman seconded; passed unanimously. Several
Council Members and the Mayor commended the committee for its work.
POLICE REPORT
Lt. Larry Johnson presented the monthly police report. Mayor Falk announced
Chief Mike Day had resigned as Chief and had asked to return to his permanent
position of Lieutenant. For the present, Mayor Falk will be taking over the
administrative duties of the Police Department until such time as a decision
is made for a replacement for the position of Chief.
UNFINISHED BUSINESS
Council Member Smith gave Second Reading, Ordinance No. 398, Series 1999:
AN ORDINANCE TO PROTECT THE ENVIRONMENT BY REQUIRING CERTAIN MEASURES TO PROHIBIT
THE DUMPING OF SEWAGE INTO BODIES OF WATER LOCATED IN THE CITY OF PROSPECT.
Cdr. Wagner of the Coast Guard reported that all boats concerned were checked
out and found to be in compliance. After discussion, Council Member Smith
moved that Ordinance No. 398 be removed from the table; Council Member Zimmerman
seconded; passed unanimously. A motion was then made to reconsider, having
the effect of killing the Ordinance and preventing its being considered again.
During following discussion, concern was expressed about the pump out station being properly winterized. Mayor Falk stated that this should be discussed with the new owner of the marina.
Council Member Simon gave Second Reading, Ordinance No. 392, Series 1999: AN ORDINANCE TO ANNEX TO THE CITY OF PROSPECT A CERTAIN TRACT OF LAND ADJACENT AND LYING TO THE NORTH AND EASE OF THE PRESENT BOUNDARY LINE IN THE ESTATES OF HUNTING CREEK. Council Member Milliman seconded. Discussion followed. Several residents were in attendance and spoke in favor of the annexation. All but two residents of the area to be annexed have agreed to the annexation.
EXECUTIVE SESSION
Council Member Burse moved the Council meet in Executive Session for purpose
of discussing possible litigation; Council Member Milliman seconded; passed
unanimously. The Council met in Executive Session from 8:17 p.m. to 8:30 p.m.
UNFINISHED BUSINESS (Continued)
Ordinance No. 392, Series 1999 was then passed on a roll call vote: For: Zimmerman,
Smith, Burse, Milliman, Simon and Tucci; Against: None.
NEW BUSINESS
Council Member Milliman gave First Reading to ORDINANCE NO. 400, SERIES 1999:
AN ORDINANCE ESTABLISHING A VEHICLE IDENTIFICATION STICKER PROGRAM IN THE
CITY OF PROSPECT. Brief discussion followed. Council Member Burse said he
was adamantly against the ordinance and stated he would not vote for passage.
Bill Clancy addressed the Council concerning the area near the intersection of U. S. 42 and Timber Ridge Drive. He is concerned about drainage, debris clean up and the number of trees taken down, which opens up the view of the new shopping center and lights. Mayor Falk stated that the road should be paved by the end of the week and at that time an inspection would be made and his concerns would be taken under consideration.

Council Member Zimmerman moved adjournment; Council Member Milliman seconded;
passed unanimously. Mayor Falk declared the meeting adjourned at 8:47 p.m.
