CITY OF PROSPECT
CITY COUNCIL MEETING
May 17, 1999

PRESENT:

Mayor Lonnie Falk; Council Members Nan Milliman, Harold Smith, Alan Simon, Lee Zimmerman, Sandra Tucci; City Attorney Judi Ciliberti; City Administrator Ann Simms; Police Chief Mike Day; Recording Secretary Phyllis A. O’Donnell.

Absent: Council Member Raymond Burse

Mayor Falk called the meeting to order at 7:30 p.m.

APPROVAL OF MINUTES:
Council Member Smith moved approval of the minutes of the regular City Council Meeting of April 19, 1999; Council Member Simon seconded; passed unanimously.

Council Member Simon moved approval of the minutes of the special City Council Meeting of April 21, 1999; Council Member Smith seconded, passed unanimously.

PUBLIC HEARINGS
SECOND PUBLIC HEARING: USE OF MONEY RECEIVED BY PROSPECT FROM LOCAL GOVERNMENT ECONOMIC ASSISTANCE (COAL AND MINERAL TAX) FUND (Approximately $135 Fiscal Year 1999-00). Mayor Falk stated this would be used for general expenses and opened the hearing for public comment. There being no public comment, Mayor Falk closed the public hearing.

SECOND PUBLIC HEARING: USE OF MONEY RECEIVED BY PROSPECT FROM STATE MUNICIPAL ROAD AID FUND (Approximately $40,000 Fiscal Year 1999-00). Mayor Falk stated that this would be used for street improvement and possibly for heating elements for entrances and steep areas for use in winter for snow and ice removal and opened the hearing for public comment. There being no public comment, Mayor Falk closed the public hearing.

 SECOND PUBLIC HEARING: SETTING THE AD VALORUM TAX RATE FOR THE CITY OF PROSPECT AT 21.25 CENTS PER $100 ASSESSED VALUATION. Mayor Falk stated that this rate has remained the same as last year and opened the hearing for public comment. There being no public comment, Mayor Falk closed the public hearing.

 COMMENTS FROM CITIZENS
Glenn Price, attorney representing Republic Bank, presented the Council with changes to the binding elements for the Prospect Village development and for Outlot #3 – Republic Bank. Primary change is location of sign to be moved off U.S. 42 and back onto Timber Ridge extension and footage increase from 3000 sq. ft. to 3200 sq. ft. Other changes include no freestanding signs, pennants, balloons or banners. No outdoor storage on the site, further restrictions for outdoor lighting and no outdoor music, entertainment or PA system audible beyond the property line or permitted on the site. Council Member Simon moved the council to approve the changes to the binding elements; Council Member Smith seconded; passed unanimously on roll call vote 5-0.

A resident asked why the minutes were two months behind in the Newsletter. Mayor Falk explained that minutes are taken at each meeting, then they have to be approved at the next meeting and then are published in the next newsletter.

Joe Dunn from the Harrods Landing Yacht Club presented a picture of the old club sign that existed before the flood. He would like to replace the sign and add “Slips Available”. No decision was made. Mr. Dunn also requested assistance in a problem he has at the marina. Some people living on boats in the marina are emptying their waste into the marina instead of using the pump-out station causing severe pollution in the marina area. He had reports of tests made by Beckmar Laboratory. A nearby resident reported her young son had been infected with deadly e. coli, possibly from picking up sticks near the marina and had spent three days in the hospital. Mr. Dunn was requesting the City pass an ordinance making it illegal to dump waste into the marina and was asking for Prospect Police enforcement. After a lengthy discussion about what the City and the City Police could do legally, it was decided that the problem was the Harbor Master’s problem and he should take responsibility. Mayor Falk stated that the City would contact the Health Department and report the problem first thing in the morning.

CONCEPT PRESENTATION: CITY LIBRARY
John Warmack from Design+, Inc. gave a computerized presentation concept presentation for the new City Library and renovation of Prospect City Hall. The design includes additional sections for meeting rooms, an outdoor courtyard and outdoor amphitheatre. This project is still in the planning mode and no definite plans have been approved, but the City will continue to explore all avenues. Residents in attendance and the City Council enthusiastically liked the ideas presented.

POLICE REPORT
Chief Day presented the monthly police report and reported that tests were given to 12 potential candidates on Sunday for the two positions available in the Police Department. After background checks are done and test results come back the elimination process will begin, but he thinks it will be a tough decision because a good group applied probably because of the salary and benefit increases in next year’s budget. Chief Day also presented a letter written by a Sutherland resident praising Officer Terry Butrum for his assistance with helping out with a problem. Mayor Falk commented that the Police Department was running better and more efficiently thanks to Chief Day and Lt. Johnson.

UNFINISHED BUSINESS
Council Member Milliman gave SECOND READING ORDINANCE NO. 394, SERIES 1999: AN ORDINANCE ESTABLISHING A BUDGET FOR THE GENERAL FUND OF THE CITY OF PROSPECT FOR THE FISCAL YEAR BEGINNING JULY 1, 1999 AND ENDING JUNE 30, 2000; Council Member Simon seconded; passed unanimously on a roll call vote 5-0.

Council Member Smith gave SECOND READING ORDINANCE NO. 395, SERIES 1999: AN ORDINANCE ESTABLISHING A BUDGET FOR THE STATE MUNICIPAL ROAD AID FUND OF THE CITY OF PROSPECT FOR THE FISCAL YEAR BEGINNING JULY 1, 1999 AND ENDING JUNE 30, 2000; Council Member Simon seconded; passed unanimously on a roll call vote 5-0.

Council Member Milliman gave SECOND READING ORDINANCE NO. 393, SERIES 1999: AN ORDINANCE REGULATING THE DISTANCE BETWEEN PACKAGE LIQUOR SALES IN THE CITY OF PROSPECT; Council Member Tucci seconded; passed on a roll call vote 3-2. For: Council Members Tucci, Simon and Milliman. Against: Council Members Zimmerman and Smith.

NEW BUSINESS
Council Member Smith gave FIRST READING ORDINANCE NO. 397, SERIES 1999: AN ORDINANCE LEVYING AN AD VALOREM TAX RATE FOR THE FISCAL YEAR 1999-2000. This is an ordinance levies a .2125 per $100 property tax.

ADJOURNMENT
