CITY COUNCIL MEETING
June 21, 1999

Mayor Falk called the meeting to order at 7:30 p.m.
APPROVAL OF MINUTES:
Council Member Smith moved approval of the minutes of the regular City Council
Meeting of May 17, 1999; Council Member Simon seconded; passed unanimously.
COMMENTS FROM CITIZENS
Several boat owners, including boat owners who live on their boats, from the
Harrods Landing Yacht Club Marina were in attendance along with their lawyer.
They expressed their displeasure about the possibility of Ordinance #398 being
passed, which seeks to regulate the contamination of water within the City
by dumping solid waste from boats. Mr. Joe Dunn, owner of the marina, had
reported to the City that boaters were dumping raw sewage into the marina;
thus, adding pollution to the marina and Harrods Creek. Inspection by the
Coast Guard, represented by Cdr. William Wagner, did verify that some boats
were dumping raw sewage in the marina. After discussion, Mayor Falk proposed
a compromise under which boaters would be inspected by the Coast Guard within
the next month and would bring their boats into compliance with federal law.
The Mayor told the boaters’ attorney he would be responsible for setting
up a time when his clients would be present for the Coast Guard inspection.
Boaters, their attorney and Cdr. Wagner agreed to the compromise with the
understanding that if there is not substantial progress on the problem by
the July City Council meeting, the Council may move to enact the Ordinance.
The Ordinance will remain on the agenda for first reading so the Council will
have the option to act in July if substantial progress has not been made.
POLICE REPORT
Lt. Larry Johnson presented the monthly police report in the absence of Chief
Mike Day, who is on vacation. Lt. Johnson said that two new officers had been
hired and one would start July 1 and the other late July or August 1. Two
new police cars have been delivered and are being readied for service. The
City was able to save $3,000 per car by picking them up in St. Louis and driving
them back.
UNFINISHED BUSINESS
Council Member Simon gave SECOND READING ORDINANCE NO. 397, SERIES 1999: AN
ORDINANCE LEVYING AN AD VALOREM TAX RATE FOR THE FISCAL YEAR 1999-2000. Council
Member Milliman seconded; passed unanimously on roll call vote 6-0.
NEW BUSINESS
Council Member Smith gave FIRST READING: ORDINANCE NO. 398, SERIES 1999: AN
ORDINANCE TO PROTECT THE ENVIRONMENT BY REQUIRING CERTAIN MEASURES TO PROHIBIT
THE DUMPING OF SEWAGE INTO BODIES OF WATER LOCATED IN THE CITY OF PROSPECT
(THE PROSPECT CLEAN WATER ORDINANCE).
Council Member Milliman gave FIRST READING: ORDINANCE NO. 399, SERIES 1999: AN ORDINANCE REGULATING THE USE AND TYPE OF OUTDOOR LIGHTING WITHIN THE CITY OF PROSPECT, KENTUCKY.
Council Member Smith read MINICIPAL ORDER NO. 1, SERIES 1999: A MUNICIPAL ORDER RELATING TO THE APPROVAL OF A DETAILED DISTRICT DEVELOPMENT PLAN AND AMENDING BINDING ELEMENTS PERTAINING TO TRACT 2-A, PROSPECT VILLAGE SHOPPING CENTER, LOCATED AT 9101 U.S. HIGHWAY 42; PLANNING COMMISSION DOCKET NO. 9-64-91 (REPUBLIC BANCORP, INC.) Council Member Milliman moved adoption; passed unanimously.
ADJOURNMENT
Council Member Smith moved adjournment; Council Member Simon seconded; passed
unanimously. Mayor Falk declared the meeting adjourned at 8:15 p.m.
