Mayor Falk, noting a quorum being present, called the meeting to order at 7:35 p.m.
APPROVAL
OF MINUTES:
Council Member Smith moved approval of minutes of the regular City Council
Meeting of May 19, 1997; Council Member Milliman seconded; passed unanimously.
INTRODUCTION
AND SWEARING-IN OF POLICE OFFICER ELGIN PRICE:
Mayor Falk introduced Elgin Price as the new Police Officer for the City
of Prospect, replacing Officer Jack Roberts, who has retired. After giving
a brief description of the hiring process, Mayor Falk swore in Officer Price
and welcomed him to the police force. Chief Nugent pinned on Officer Price’s
badge and officially welcomed him to the Department.
OPENING
OF CONTRACTS:
Mayor Falk opened contract bids for the operation and maintenance of the
Prospect Wastewater Treatment Facilities. One contract was received from Eubank
Hall and Associates. After consultation with City Engineer Woody Smither as
to technical details, the mayor said he would award the contract.
At this point, Mayor Falk introduced to the Council model airplanes that will be given out during the “air show” for the 4th of July Celebration. The planes are balsa wood kits with the City of Prospect logo and name and also the 228-COPS number on the wings.
COMMENTS
FROM RESIDENTS:
George Sworin of 7105 Hunting
Creek Drive expressed his frustration over the drainage problem that exists
between his property and the new house being built next door. This problem
has existed for nine months and he asked the Council to put a stop work order
on any construction until the drainage problem is completed. Council Member
Burse moved that a stop work order be issued until the drainage problem can
be resolved. Council Member Smith seconded; passed unanimously on a roll call
vote. For: Tucci, Simon, Milliman, Burse Smith, Zimmerman. Against: None.
FINANCIAL
REPORT:
Mayor Falk presented the May 1997 financial report.
POLICE
REPORT:
Chief Nugent reported that there has been a setback with the Smart Cart.
There was a problem with the batteries and they are in the process of being
replaced.

BUSINESS:
Council Member Smith gave SECOND READING, ORDINANCE NO. 342, SERIES 1997:
AN ORDINANCE RELATING TO THE COMPREHENSIVE PLAN ENTITLED CORNERSTONE 2020.
Council Member Milliman seconded. Council Member Simon voiced his concern
over the plans for the Wolf Pen area being the gateway to Prospect. Lisa Hite
from the Planning Commission spoke briefly, answering questions and explaining
future plans. Passed on a roll call vote 5-0. For: Tucci, Milliman, Burse,
Smith, Zimmerman; Abstain: Council Member Simon.
Council Member Milliman gave SECOND READING, ORDINANCE NO. 343, SERIES 1997: AN ORDINANCE AMENDING THE CITY OF PROSPECT CODE OF ORDINANCES 29.03(H) RELATING TO THE HEIGHT OF WEEDS IN THE CITY. Council Member Burse seconded; passed unanimously on a roll call vote. For: Tucci, Simon, Milliman, Burse, Smith, Zimmerman. Against: None.
Council Member Simon gave SECOND READING, ORDINANCE NO. 344, SERIES 1997: AN ORDINANCE AMENDING THE CITY OF PROSPECT CODE OF ORDINANCES 150.02(E) RELATING TO GARAGES. Council Member Tucci seconded. Council Member Burse asked whether the 30-degree prohibition angle to a street was sufficient. The mayor said it was a compromise, but there are real problems attached to corner lots and this portion of the ordinance seeks to address that in a fair manner. Passed unanimously on a roll call vote. For: Tucci, Simon, Milliman, Burse, Smith, Smith. Against: None.
NEW
BUSINESS:
Mayor Falk reported the City’s efforts to relieve traffic on U.S. 42 have
met with success and that the State Highway Department plans to widen the
highway by adding a turning lane from the Harrods Creek Bridge to the River
Road intersection and will be installing a stop light at the entrance of the
Landings at Timber Ridge Drive. The speed limit on U.S. 42 will not, however,
be lowered to 35 miles per hour. The mayor also said he hopes to be able to
make some progress to have the current utility lines placed underground if
the road widening means the present poles will have to be moved. This, however,
is very much up in the air at this time. There was also brief discussion initiated
by Council Member Simon about the possibility of sidewalks along U.S. 42.

passed unanimously. Mayor Falk declared the meeting adjourned at 8:30 p.m.
