CITY COUNCIL MEETING
July 16, 2007

PRESENT:
Mayor Todd Eberle; Council Members Loretta Ertel Sandra Leonard, Stuart Miles, Alan Simon, Sandy Tucci and Lee Zimmerman; City Attorney Grover Potts, City Administrator Ann Simms; Chief Marvin Wilson; Recording Secretary Ann Melton; Court Reporter Bruce Handy.
Mayor Eberle called the meeting to order at 7:30 p.m.
APPROVAL OF MINUTES:
Council Member Leonard moved approval of the minutes of the regular City Council Meeting of June 18, 2007; Council Member Simon seconded: passed unanimously.
COMMENTS FROM CITIZENS:
Michelle Monda of 8509 Westover Drive informed the Council she was here tonight to voice her abjection to the people who had cordoned off certain sections of the Cowley Open Space for their own personal use; in taping off these areas, they were using blue and yellow masking tape and some kind of awning cover. Michelle thought it looked very tacky and took away from the beauty of the surrounding area. Mrs. Monda did not have a problem with the city marking off seating as she understands we have dignitaries coming to the fireworks display and must have a seat. She did not object to blankets placed on the grassy areas. But she felt the tape was appalling. No one can go early and reserve space for Thunder so why do these people think that they can do it for our little July 4 th event? Council Members will see what can be done next year so it will not look so appalling to anyone.
POLICE REPORT:
Chief Marvin Wilson presented the police report. There were no questions. Chief Wilson advised the Council that he had written a letter of commendation to his police officers, Patti Baker and her assistant volunteer Katie Baker, all the volunteers from the sheriffs department, explorers and cadets for a job well done during the City of Prospect's 4 th of July celebration.
NEW BUSINESS:
Mayor Eberle thanked Council Member Alan Simon for being Chairman and Council Member Lee Zimmerman being Co-Chairman of this year 4 th of July celebration. We all thank you for an outstanding job. I want to thank all our Council Members and city staff along with police department and the many volunteers for all their hard work. This event would not be what it is without everyone's help and support. I wanted to bring you up to date on the trail that the City of Parks was considering that might spur off or just change direction and come through Prospect that Metro wanted us to contribute $25,000 for a feasibility to do that. I'm very pleased to tell you that Kelly Downard and four other Metro Councilmen pooled their infrastructure money, and have paid for the whole feasibility study. So I will keep Council posted when I receive more information.
UNFINISHED BUSINESS:
Mayor Eberle advised members of the Council that City Attorney Potts has designed an amendment to the development agreement and would he please explain this to the Council. The first amendment to the development agreement amends Binding Element Number 19, which was put in when the first failure occurred. Attorney Grover Potts has rewritten that to address the second failure, and divided the work that is being done to the upper slope from the work being done to the lower slope moving the lower slope to Binding Element Number 20 a brand new Binding Element. In Binding Element Number 19, Attorney Potts said he eliminated dates that had already transpired, and added dates that were relevant.
EXECUTIVE SESSION:
At the Mayor's request, Council Member Simon moved the Council to go into executive session to discuss potential or pending litigation. Council Member Ertel seconded; passed unanimously.
The Council went into Executive Session at 8:05 p.m.
ADJOURNMENT:
Following the Executive Session, the Mayor announced for the record the Council discussed possible litigation with no action taken. Council Member Simon moved adjournment; Council Member Tucci seconded; passed unanimously.
Mayor Eberle declared the meeting adjourned at 8:25 p.m.
