CITY OF PROSPECT
CITY COUNCIL MEETING
July 18, 2005

PRESENT:
Mayor Lonnie Falk; Council Members Nan Milliman, Harold Smith, Alan Simon, Todd Eberle, Sandra Tucci; City Attorney Grover Potts, City Administrator Ann Simms; Police Chief Marvin Wilson; Recording Secretary Ann Melton; Court Reporter Bruce Handy.

Mayor Falk called the meeting to order at 7:28 p.m.

APPROVAL OF MINUTES:
Council Member Smith moved approval of the minutes of the regular City Council Meeting of June 20, 2005; Council Member Milliman seconded; passed unanimously.

COMMENTS FROM CITIZENS:
Joe Henry and Joe Kehlbeck both residents of Estates of Hunting Creek, addressed the Council to express their concern the City will lose much of its “green” look and beauty if the outbuilding ordinance as presently drafted is approved and residents in subdivision-sized lots can construct an outbuilding on their property. Both emphasized the importance of maintaining Prospect’s natural beauty. Thomas and Jennifer Jacques also spoke to the council concerning the outbuilding ordinance and the effect it will have on their property on U.S 42. They have a large lot which would allow an outbuilding but not the required 100 foot distance from the property line if the proposed Ordinance is approved. Mayor Falk led Council Members through a lengthy discussion of the various provisions of the proposed Ordinance and the City Attorney was directed to prepare a new Ordinance along those lines.

Stuart Miles, a new resident of Fox Harbor, addressed the Council on his interest in establishing nature trails within the City. Miles said he had worked on such a project along Beargrass Creek at his previous residence in Butchertown. Mayor Falk said he would be in touch with Miles to investigate some possibilities, as the City has been working on several potential projects of this nature for some time.

POLICE REPORT:
Chief Wilson presented the Police Report. There were no questions. The Chief commented about a group of solicitors in the City selling magazines without a permit. Two citations were issued and all material was confiscated and retained as evidence. The driver for the group was arrested on an outstanding warrant. The Chief also commented on six officer commendations that were part of the Council Members’ packets.

Council Member Simon thanked the Police Department for the fine job they did on the Fourth of July and Council Member Milliman thanked Mayor Falk, Ann Simms and the other Council Members for all their help during the Fourth. Council Member Tucci said she wanted to thank the City employees for all their hard work and hours they put in for the Fourth of July celebration too.

UNFINISHED BUSINESS:
Council Member Milliman gave SECOND READING, ORDINANCE NO. 455, SERIES 2005: AN ORDINANCE ENACTING AND ADOPTING THE 2005 SUPPLEMENT TO THE CODE OF ORDINANCES OF THE CITY OF PROSPECT; seconded by Council Simon; passed on a 5-0 roll call vote.

Council Member Simon gave SECOND READING, ORDINANCE NO. 456, SERIES 2005: AN ORDINANCE AMENDING SECTION 150.02(D) OF THE CODE OF ORDINANCES OF THE CITY OF PROSPECT SO AS TO SET REQUIREMENTS FOR OUTBUILDINGS IN RESIDENTIAL AREAS OF THE CITY. Tabled.

EXECUTIVE SESSION:
At the Mayor’s request, Council Member Smith moved the Council go into executive session to discuss possible litigations: Council Member Eberle seconded; passed unanimously.

The Council went into Executive Session at 9:40 p.m.

ADJOURNMENT:
Following the Executive Session, the Mayor announced for the record the Council discussed possible litigation.

Council Member Tucci moved adjournment; Council Member Milliman seconded; passed unanimously. Mayor Falk declared the meeting adjourned at 10:05 p.m.
