CITY OF PROSPECT
CITY COUNCIL MEETING
February 19, 2007

PRESENT:
Mayor Todd Eberle; Council Members Loretta Ertel, Sandra Leonard, Alan Simon, Sandy Tucci; City Attorney Grover Potts, City Administrator Ann Simms; Chief Marvin Wilson,   Recording Secretary Ann Melton; Court Reporter Bruce Handy.

ABSENT:  
Council Members Stuart Miles and Lee Zimmerman.

Mayor Eberle called the meeting to order at 7:30 p.m.   Mayor Eberle presented the 2007 Beach Craigmyle Award to former Council Member Anne "Nan" Milliman.   Mayor Eberle praised Nan Milliman for all her years of dedication to the City of Prospect and as a longtime resident of both the Fox Harbor and later Hunting Creek Estates neighborhoods.

APPROVAL OF MINUTES:
Council Member Simon moved approval of the minutes of the regular City Council Meeting of January 8, 2007; Council Member Tucci seconded: passed unanimously.

COMMENTS FROM CITIZENS:
None

POLICE REPORT:
Chief Wilson presented the police report and provided the Council with an update regarding graffiti in the City.   Officers recently arrested three juveniles for committing the crimes.   They were responsible for about 95% of the graffiti.   The Police Department is working with a group of residents at Hunting Hills Condominiums to create a Block Watch.   Police are also working with David Gay of the Woodlands who is spearheading that area's effort to create a Block Watch.   Officers are scheduled to meet with Mr. Gay and other residents in early March.   The City of Louisville is offering training concerning Homeowners' Associations during the next four weeks.   Lieutenant Dennis Wine and Officer Heather Loeser (Community Resource Officer) will attend applicable sessions to gain an understanding as to how Homeowners' Associations operate their protocol to address problems, and what officers can do to assist them in resolving problems.

NEW BUSINESS:
The Council received the written REPORT OF THE AD HOC COMMITTEE ON SIGNAGE RELATING TO RADIO/ELECTRONIC ANIMAL CONTROL FENCES.   The Committee consisted of Prospect resident Mike Scott, Chair; Prospect Resident Joe Dean Henry; Council Member Sandra Leonard; Council Member Stuart Miles; and Prospect Chief of Police Marvin Wilson.    The Committee met on Monday, February 12, 2007.   It was decided and recommended to the Council that it was not advisable to move forward to change the Prospect Code of Ordinances concerning the invisible fence issue for a variety of reasons including:   1) there is not a high frequency of complaints, 2) it is difficult for individuals to view signage depending on the shape of the residential lot; and 3) there is an existing Louisville Metro ordinance in place concerning the issue.   

Council Member Simon gave FIRST READING for the purposes of introduction and discussion to, ORDINANCE NO. 475, SERIES 2007: AN ORDINANCE AMENDING CHAPTER 156 OF THE CODE OF ORDINANCES OF THE CITY OF PROSPECT RELATING TO PRIVATE AND PUBLIC ROADS; seconded by Council Member Tucci.   Two citizens inquired as to the scope and intent of the proposed ordinance.   It was noted that the ordinance was designed to set standards only and not designed to adopt any specific private roads as public roads.  

Council Member Tucci gave FIRST READING for the purposes of introduction and discussion to, ORDINANCE NO. 476, SERIES 2007: AN ORDINANCE AMENDING CHAPTER 152 OF THE CODE OF ORDINANCES RELATING TO STANDARDS APPLYING TO FENCES; seconded by Council Member Simon.

Council Member Simon read and introduced MUNICIPAL ORDER NO. 1, SERIES 2007: AN ORDER CONSENTING TO THE NOMINATIONS OF THE MAYOR FOR CITIZENS OF THE CITY TO SERVE ON THE CITY OF PROSPECT CODE ENFORCEMENT BOARD AND AFFIXING TERMS OF OFFICE THERETO; seconded by Council Member Ertel; passed unanimously.

EXECUTIVE SESSION:
At the Mayor's request, Council Member Simon moved the Council go into executive session to discuss litigation; Council Member Tucci seconded; passed unanimously.

The Council went into Executive Session at 8:00 p.m.

ADJOURNMENT:
Following the Executive Session, the Mayor announced for the record that the Council had discussed current and prospective litigation issues. No action taken.

Council Member Simon moved adjournment; Council Member Ertel seconded; passed unanimously.

Mayor Eberle declared the meeting adjourned at 8:30 p.m.
