Mayor Falk called the meeting to order at 7:30 p.m.
NEW BUSINESS
Council Member Milliman gave FIRST READING, ORDINANCE NO. 427, SERIES 2002:
AN ORDINANCE RELATED TO CHANGING THE ZONING FROM OR-1 OFFICE/RESIDENTIAL TO
C-1 COMMERCIAL ON PROPERTY LOCATED AT THE REAR OF 9105 U.S. HIGHWAY 42 AND
BEING IN THE CITY OF PROSPECT
Council Member Milliman gave FIRST READING, ORDINANCE NO. 428, SERIES 2002:
AN ORDINANCE CHANGING THE ZONING FROM OR-1 OFFICE/RESIDENTIAL TO C-1 COMMERCIAL
ON PROPERTY LOCATED AT THE REAR OF 9105 U.S. HIGHWAY 42 AND BEING IN THE CITY
OF PROSPECT
Mayor Falk pointed out the meeting was a special meeting to introduce the
two ordinances relative to the request for rezoning and that the primary reason
for the special meeting was because of the delay on the part of the Louisville
and Jefferson County Planning Commission in forwarding materials to the City.
The City must act on a zoning change recommendation within 90 days under present
state law. The Mayor said he would again attempt to seek a change in this
law by the legislature next year.
The Mayor also advised all in attendance the meeting did not include a public
hearing and, as such, no testimony would be taken nor allowed. Council Members,
of course, could ask questions but the Mayor cautioned those responding to
such questions to limit themselves to responses as opposed to stating opinions
and positions.
Council Member Simon asked the Mayor if it would be possible for Police Chief
Marvin Wilson to prepare a study of safety and traffic concerns the rezoning
might engender. Chief Wilson replied he would be able to complete such a study
for the Council before its regular meeting next week.
In reply to a question, proponents of the zoning change said the plan for
the site has changed since approved by the Planning Commission. Entrance and
egress now involves a 24-foot road cut into U.S. 42 as opposed to egress from
Carslaw Court across the property leased to Dairy Mart.
Proponents also said the development plan for the tract originally was intended
for use by a bank with a drive-through area but that in light of the complications
involving the egress to the site, that particular use may not happen. The
development plan, however, does include provision for drive-through lanes.
Council Member Smith moved adjournment; Council Member Krost seconded. The
meeting was adjourned by the Mayor at 7:55 p.m.
