CITY OF PROSPECT
SPECIAL CITY COUNCIL MEETING
August 2, 2006

PRESENT:
Mayor Joe Kehlbeck; Council Members Nan Milliman, Alan Simon, Todd Eberle, Harold Smith, Sandy Tucci; Attorney Grover Potts, City Administrator Ann Simms; Chief Marvin Wilson; Recording Secretary Ann Melton; Court Reporter Joyce Newton.

Mayor Kehlbeck called the meeting to order at 7:30 p.m.   He advised the Council that three boy scouts were in attendance to earn their Citizenship in the Community Merit Badge. Their names were Connor Murphy, Harrison and Elliott Fowler.

APPROVAL OF MINUTES:
Council Member Smith moved approval of the minutes of the regular City Council Meeting of July 24, 2006; Council Member Milliman seconded; passed unanimously.

UNFINISHED BUSINESS:
ORDINANCE NO. 470, SERIES 2006: AN ORDINANCE AMENDING SECTION 152.02 OF THE CODE OF ORDINANCES OF THE CITY OF PROSPECT RELATING TO FENCE STANDARDS was read for the second time and passed on a 5-0 vote. For Tucci, Simon, Milliman, Smith and Eberle.

Pursuant to a discussion ORDINANCE NO. 471, SERIES 2006: AN ORDINANCE AMENDING SECTIONS 31.21(E) AND 32.01(C) OF THE CODE OF ORDINANCES OF THE CITY OF PROSPECT SO AS TO ESTABLISH THE COMPENSATION OF ELECTED OFFICIALS was read for the second time and passed on a 4-1 vote. For Tucci, Simon, Smith and Eberle. Opposed Milliman.

Mayor Kehlbeck advised the Council that Chris Aponte, Chief of Harrods Creek Fire Department went before the Land Development and Planning Group and they approved a 150 foot cell tower.   Chief Aponte says a maximum of 110 foot would be adequate for his purposes.

Mayor Kehlbeck told the Council there had been some discussion relating to the problem associated with movement of the earth on the banks of Harrods Creek on the Overlook property. The City hired an independent engineer Ms. Peggy Duffy, who brought her report with her to the Council meeting. After a brief discussion, it was decided that she would meet with the engineers from the Overlook Condominiums and return to the next meeting to report her findings. Approval of the Metro recommendations will be discussed at that time

NEW BUSINESS:
FIRST READING, ORDINANCE NO. 472, SERIES 2006: AN ORDINANCE AMENDING SECTION 150.02 OF THE CODE OF ORDINANCES OF THE CITY OF PROSPECT SO AS TO SET REQUIREMENTS FOR OUTBUILDINGS IN RESIDENTIAL AREAS OF THE CITY SO AS TO DEFINE A GAZEBO.

ADJOURNMENT:
Council Member Simon moved adjournment; Council Member Milliman seconded; passed unanimously.

Mayor Kehlbeck declared the meeting adjourned at 8:38 PM.
