CITY COUNCIL MEETING

PRESENT:
Mayor Lonnie Falk; Council Members Nan Milliman, Harold Smith, Alan Simon, Todd Eberle, Lee Zimmerman, City Attorney Grover Potts, City Administrator Ann Simms; Police Chief Marvin Wilson; Recording Secretary Ann Melton; Court Reporter Bruce Handy.
Mayor Falk called the meeting to order at 7:28 p.m.
APPROVAL OF MINUTES:
Council Member Smith moved approval of the minutes of the regular City Council Meeting of July 18, 2005; Council Member Eberle seconded; passed unanimously.
COMMENTS FROM CITIZENS:
Mayor Falk reintroduced Mr. Stuart Miles a Fox Harbor Resident who spoke to the Council last Month regarding walking trails and bike paths in the City of Prospect. Mr. Miles will head a new committee who will examine the City's options and prepare plans for bike and walking trails. If anyone would like to be on this committee please call City Hall.
Bridgepointe Homeowner Association President Jim Halvatgis brought the Council up to date on how the postcard survey was going and the choice of how the Bridgepointe Residents felt about closing the back entrance to Bridgepointe. Maria Mackey told the Council 117 postcards were returned out of 156 residents with 84 saying "yes" to the closing of the back entrance. They have formed a committee to check into other areas of concern and will be back in touch with the Council.
Mayor Falk said that construction will begin early next year at the interchange at U.S. 42 and Gene Snyder Freeway. After a meeting between the City, the state and representatives of Lochner Engineering who have the contract for the Kentucky portion of the East End Bridge Project. The off-ramp from the Snyder will be moved so it parallels the on-ramp and a traffic signal will be added.
POLICE REPORT:
Chief Wilson presented the Police Report. There were no questions. The Chief told the Council about the arrest of three juveniles from St. Matthews breaking into one of the Condos cars. The Police Officer's have given 7 speeding tickets in Sutherland, 6 speeding tickets on Hunting Creek Drive and 8 tickets on Fox Harbor Road for running through a stop sign in the last month.
UNFINISHED BUSINESS:
Council Member Milliman gave FIRST READING, ALTERNATE ORDINANCE NO. 456, SERIES 2005: AN ORDINANCE AMENDING SECTION 150.02 OF THE CODE OF ORDINANCES OF THE CITY OF PROSPECT SO AS TO SET REQUIREMENTS FROM OUTBUILDINGS IN RESIDENTIAL AREAS OF THE CITY.
NEW BUSINESS:
Council Member Simon gave FIRST READING, ORDINANCE NO. 457, SERIES 2005: AN ORDINANCE AMENDING SECTION 150.03(A) OF THE CODE OF ORDINANCES OF THE CITY OF PROSPECT SO AS TO DESIGNATE BOATS AS STRUCTURES WHICH MAY NOT BE USED AS RESIDENCES.
Council Member Smith gave FIRST READING, ORDINANCE NO. 458, SERIES 2005: AN ORDINANCE AMENDING SECTION 114.09(E) OF THE CODE OF ORDINANCES OF THE CITY OF PROSPECT SO AS TO ALLOW LIMITED SALE OF DISTILLED WINE AND SPIRITS ON SUNDAYS; Seconded by Council Simon; passed on a 5-0 emergency roll call vote.
Council Member Zimmerman read MUNICIPAL ORDER NO 1, SERIES 2005: AN ORDER SETTING THE DATE OF THE CITY OF PROSPECT REGULAR COUNCIL MEETING SCHEDULED FOR FEBRUARY 20, 2006 TO FEBRUARY 6, 2006; Council Milliman seconded; passed unanimously.
