CITY COUNCIL MEETING
MINUTES
November 14, 2011

ATTENDANCE:                                                                                            

Present:   Mayor Todd Eberle; Council Members Loretta Ertel, Sandra Leonard, Stuart Miles, Mike Scott, Alan Simon and Sandy Tucci; City Attorney Grover Potts; City Administrator Ann Simms; Police Lieutenant Dennis Wine; Recording Secretary Holly Clark; Court Reporter Rose Mary Kithcart.   

Mayor Eberle called the meeting to order at 7:00 p.m. 

APPROVAL OF MINUTES:

Council Member Sandra Leonard moved approval of the minutes of the regular City Council Meeting of October 17,   2011; Council Member Sandy Tucci seconded; passed unanimously.

MAYOR'S REPORT:  

The 14 th Annual Pun'kin Paint'n Celebration was held Sunday, October 23 rd at Cowley Park and was very well received.   The family event featured the traditional pumpkin painting contest and the Grand Costume Parade as well as live music, inflatables, carriage rides, food trucks, a balloon artist and ESPN radio games.   Mayor Eberle thanked the City's 2011 Community Events sponsors including the two Prime Sponsors Republic Bank and the Merchants of Prospect Pointe Shopping Center, as well as the eleven Supporting Sponsors, for their support of the event.    

The last of the three Second Sunday Concert Series was held on Sunday, November 13 th

at Cowley Park.   It featured the Louisville band The Deloreans.   Food was provided by several food trucks.   The Deloreans as well as the bands at the two earlier concerts were very well received and the City is planning to hold additional concerts in 2012.  

Mayor Eberle reported that 67% of budgeted revenues have been received to date and 28% of expenses have been disbursed to date in the current fiscal year.   The annual independent audit will reallocate some of revenues and expenses back to the last quarter of the previous fiscal year.   The audit will be presented at the December Council Meeting.  

Parks and Recreation Committee Report:   Linda Wardell announced that six Eagle Scout Candidates will be in attendance at the December 11 th City Council Meeting to be recognized for   Eagle Scout projects which they have conducted in the City.   They will summarize their projects and answer any questions. The fundraising drive for the Putney Pond and Woodlands Wetlands Boardwalk is continuing and donations will be accepted until late November or early December.   If the financial goal is reached construction will begin as soon as weather permits.   Council Member Stuart Miles announced a trail work day at Harrods Creek Park for November 19 th .   Improvements will be made to the trail which runs from Montero Drive to Harrods Creek.       

Forestation Board Update:   The Prospect Forestation Board held its 4 th Annual Arborfest Celebration on Saturday, October 29th Board President Lee Tucci, reported that the successful event included the planting of two trees in Little Hunting Creek Park, tree climbing and other arborist demonstrations, consultations with Kentucky Division of Forestry staff, distribution of free Forestation Board and general tree literature as well as free daffodil bulbs given out in conjunction with Mayor's Beautiful Day.   The Forestation Board recently approved the removal of several dead trees in public areas of the city, is planning a "tree of heaven" eradication work day, and is working on renewal of Tree City USA status from the National Arbor Day Foundation.

Library Committee Update:   Council Member Sandra Leonard reported that the Prospect Library's Fall Book Sale was very successful with the receipt of over $800.   Plans are being made to purchase books for the permanent collection with the proceeds.   The Library is now accepting donations of books for the Spring Book Sale to be held in May 2012.  

Mayor Eberle addressed the timing of the traffic control signals at intersections on US Highway 42. Although there has been some change in the timing of the lights, they could be adjusted closer to what the previous settings were. Mayor Eberle continues to meet with Metro officials to remedy the issue.

City Administrator Ann Simms noted that the new generator should be delivered in the following week and installed shortly thereafter. This will ensure that City Hall will have backup power and continue to operate during emergencies and power outages.

POLICE REPORT:

Police Lieutenant Dennis Wine gave the monthly police report.   He noted two incidents of shoplifting at local businesses and, though video evidence has been obtained, the perpetrator(s) have not yet been apprehended.   There continues to be a problem with theft of property from vehicles and Lieutenant Wine expressed concern that thefts were made from vehicles which were unlocked and not garaged.   The recent thefts were concentrated in The Landings, Hunting Creek and Innisbrook neighborhoods.   Lieutenant Wine stressed the importance of locking vehicles and securing them in a garage or on the driveway close to an illuminated area.   Valuables should be removed from parked vehicles or locked in the trunk.   The Department feels many of the vehicle thefts are committed by young persons on weekends or days when school is not in session.  

EXECUTIVE SESSION:

Mayor Eberle noted he had been advised by City Attorney Grover Potts that an executive session was needed to discuss proposed or pending litigation against or on behalf of the city.   Council Member Alan Simon moved for recess to executive session; Council Member Loretta Ertel seconded; motion was unanimously approved.

Upon return from Executive Session Mayor Eberle reconvened the meeting noting that discussions had occurred but no decisions had been made by the City Council during the session.  

PUBLIC COMMENT:

Kathy Jacobs, Executive Director of the Prospect Area Chamber of Commerce (PACC), presented a short history of PACC as well as their organizational status, current operations and future goals.   Prospect resident John Herzfeld also gave a brief statement on the history of PACC.  

UNFINISHED BUSINESS:  

There was no unfinished business to be brought before the Council.

NEW BUSINESS:

Council Member Mike Scott noted that he had received expression of concern about litter at the entrances to subdivisions within the city.   Discussion followed about the possibility of an "adopt a street program" or other neighborhood efforts to reduce litter.   Council Member Sandra Tucci noted that the Fox Harbor neighborhood has several individuals who regularly patrol the neighborhood entrance area for litter.   Police Lieutenant Dennis Wine reminded citizens to notify the police department if they see someone littering and if possible provide a description of the vehicle and/or a license plate number.

ADJOURNMENT:

There being no further action to come before the Council, Council Member Alan Simon moved to adjourn.   Council Member Loretta Ertel seconded.   Motion passed unanimously on a voice vote.   Mayor Eberle declared the meeting adjourned at 7:53 p.m.
